  1. Acceptance of Terms 

Welcome to the official website of the Youngstown Community School (the “School”), a tuition-free public charter school operating under the laws of the State of Ohio. By accessing or using this website, mobile applications, or any online services managed by the School (collectively, the “Site”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Site. 

  1. Governing Law and Jurisdiction 

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action arising out of these Terms or use of the Site must be filed in the appropriate court located in Mahoning County, Ohio. 

  1. Student Data Privacy & Compliance 

As a public community school in Ohio, the School prioritizes student data privacy and operates in strict compliance with federal and state privacy statutes: 

  • FERPA & Ohio Law: The School protects student education records as required by the federal Family Educational Rights and Privacy Act (FERPA) and Ohio Revised Code (ORC) Section 3319.321. 
  • COPPA Compliance: In accordance with the Children’s Online Privacy Protection Act (COPPA), the School does not knowingly permit children under 13 to provide personal information directly to the Site without verifiable parental consent. 
  1. Third-Party Educational Tools and Services 

The School utilizes various third-party software applications, learning management systems, and digital platforms to enhance student learning and streamline school-to-home communications. 

  • Independent Policies: These third-party vendors maintain their own independent terms of service and privacy policies.
  • Limitation of Liability: The School does not control and is not responsible for the privacy practices, content, or availability of these external platforms. Users are encouraged to review the individual policies of third-party vendors when redirected to external sites. 
  • School Consent: By enrolling your child in the School, parents/guardians acknowledge that the School may consent to the collection of student data by authorized third-party vendors solely for educational purposes on behalf of the parent. 
  1. No Financial Transactions or Payment Portal 

This Site is strictly informational and instructional. The School does not collect payments, processing fees, or monetary donations directly through this Site. Any external links to third-party services for school lunch balances, student fees, or uniform purchases are governed by those specific vendors’ terms. The School does not collect, store, or process credit card numbers or financial account information on this Site. 

  1. Acceptable Use Policy 

All users of the Site—including students, staff, parents, and community members—must use the platform responsibly. 

  • Prohibited Conduct: Users may not post, transmit, or upload any material that is defamatory, offensive, harassing, obscene, infringing on intellectual property, or violative of Ohio public records law. 
  • Security Interference: Users must not attempt to bypass the Site’s security infrastructure, introduce malware, or disrupt the network layout. 
  1. Ohio Public Records Act 

Visitors should be aware that public charter schools (community schools) in Ohio are public entities subject to the Ohio Public Records Act (ORC Section 149.43). Information submitted through the Site (such as contact forms, public comments, or emails sent to school staff) may be subject to disclosure upon request, unless an explicit statutory exemption applies.
